This seems like and unbelievably undemocratic component of our system from a broad perspective. Based upon the premise that our government is supposed to represent the interest of the people, it is troublesome for two apparent reasons. (1) How little the average citizen knows about the aforementioned legal process, and (2) how little oversight or transparency is inherently built into this system.
